CCIA Files Amicus Brief In Limewire Copyright Case

Washington, DC - A coalition of trade associations representing small to large companies and public interest groups have filed a friend of the court brief today in the case of Arista Records v. Limewire.

Because many of the facts of the case are under seal, the brief supports neither party, but seeks to inform the court about how important it is to strike the right balance when it comes to secondary liability doctrines under copyright law. The Computer & Communications Association joined with the Consumer Electronics Association, Electronic Frontier Foundation, and others to point out that if secondary liability rules are used to try to protect copyright owners, they must be used carefully and not in a way that may chill legitimate innovation.

"We are not allowed to know all the details of this case, but we do know that our copyright law does not seek to punish innovators merely because a product is used for some infringing purpose. We have to ensure that the incentive to invent does not get buried under a stack of lawsuits," said Ed Black, President & CEO of the Computer & Communications Industry Association.
