Supreme Court Hears Key Owners' Rights Case
Yesterday, despite the hurricane, the Supreme Court held oral arguments in several cases, including Kirtsaeng v. Wiley.  I wrote a post last week for DisCo where I explained some of the policy implications of an adverse ruling on the first-sale doctrine, and why first-sale is essential for online commerce.  CCIA has been following this issue, and filed an amicus brief [PDF], and joined as a founding member of the newly-created Owners’ Rights Initiative (ORI).  Below is an excerpt from my post, highlighting and expounding on a key excerpt from the dissent in the Second Circuit:

Research, STEM Raised During Foreign Policy Debate

Despite being the foreign policy debate, basic research, competitiveness and science and math education was added in to last night’s face off between President Obama and Governor Romney.

ETNO’s Ideas of the Future of Telecoms the Modern Equivalent of “Beggar thy Neighbour” Trade Policies
CCIA was glad to see that the telecommunications regulators of Europe chose to reject the proposals of the European Telecommunications Network Operators' Association (ETNO) at their meeting in Istanbul yesterday. It was the right choice for Europe but it also demonstrates Europe’s commitment to looking for solutions for today’s issues today, rather than harking back to the business models of the past.

Immigration and Entrepreneurship Discussed at AEI Book Forum

The American Enterprise Institute’s book forum titled “Better Capitalism: Reviving America’s Entrepreneurial Engine” today featured Robert E. Litan and Carl J. Schramm, the authors of the book “Better Capitalism: Renewing the Entrepreneurial Strength of the American Economy.”  One of the issues discussed was the need to revamp immigration policies for highly skilled immigrants.

Brookings Panel on "Fostering Internet Competition"

The Brookings Institute held a panel discussion Wednesday on “Fostering Internet Competition” to highlight a new Brookings paper “How to Maintain a Competitive Internet.” Darrell West, who moderated the discussion, wrote that by 2016 analysts estimate the digital economy will amount to $4.2 trillion among G-20 nations – nearly double the $2.3 trillion for 2010.

International Regulation Unnecessary for Global Internet Deployment

The ITU has not revised its regulations (ITRs) governing things like satellite spectrum slots and telephone network connections since 1988.  No matter, the global Internet is working very well anyway.   


Except where there’s little or no access. Some countries that have struggled with the economics or politics of broadband access, and sometimes both, are looking to the ITU for help.

OECD Report Highlights Economic Growth From Internet
Yesterday, the OECD published a new report on the development and future outlook of the Internet economy. Titled “OECD Internet Economy Outlook”, this report reveals the importance of the Internet economy for driving growth and innovation. The report shows how the Internet economy has transformed peoples' and businesses’ lives in a decade full of disruptive change. Below are some key facts that policymakers across the globe should keep in mind when making policies that impact on a sector growing and creating jobs at an unprecedented rate.

The Internet Radio Fairness Act Will Encourage Innovation and Competition

In late September, the bipartisan bicameral Internet Radio Fairness Act (IRFA) was introduced by Reps. Chaffetz, Issa, Lofgren, and Polis in the House, and Sen. Wyden in the Senate. This bill would correct the current inequity in the way performance royalty rates are calculated.  Currently, services classified as webcasters pay much higher fees than other digital radio services.  Last year Pandora paid 54% of its revenues to royalties, while Sirius XM paid 8%.  This disparate treatment is based on what services were “pre-existing” in 1998 when this regulation was created.
