Online Privacy, Security Action This Week

Washington - For those who don’t keep as close an eye on privacy, the past week has seen a flurry of activity on a number of privacy related fronts from the US Congress. Topics have included cybersecurity, government surveillance, and the Do Not Track process. Most of these conversation are obviously still ongoing, but a summary after this intense week and a half of proceedings seemed appropriate.

Panelists Discuss Future Internet Governance At World Press Freedom Day Event
Washington - Academics, companies and a State Department official outlined the challenges ahead for Internet governance and Internet freedom at a National Press Club event marking World Press Freedom Day Wednesday. The National Endowment for Democracy hosted the event.

The Underestimated Challenge for E-Commerce in Europe: Non-Notification of National Laws

Brussels - As CCIA has repeatedly reported, Germany was the first country in the European Union to have passed a law, called the Leistungsschutzrecht, that extends copyright protection to text excerpts, like snippets, generated by search engines and online aggregators. Even though the legislature has in the end somehow tried to minimize the impact on online businesses, by excluding ‘smallest text excerpts’ from the scope of the law, the impact of the law remains uncertain and we expect years of litigation so clarify the law.

CCIA Files Comments with PTO in Response to Software Patent Roundtables

Washington - CCIA submitted comments on software patent quality to the PTO on Monday. 

In February, the PTO announced that it would hold roundtable talks on improving the quality of software patents. The PTO also sought comments on two particular subjects: First, ways in which the PTO can improve the clarity of claim boundaries in software patents that use functional claims. Second, any further suggestions as to how the PTO could improve software patent quality, such as standards for obviousness in light of prior art.

CCIA Warns Congress About Internet Governance Bill

Capitol Hill - CCIA wrote to members of Congress today as they prepare to mark up a new Internet Freedom bill. In the letter to leaders of the Energy and Commerce Committee and its Subcommittee on Communications and Technology, CCIA warned that legislation, designed to reinforce U.S. support for a global open Internet free of international regulation, is not only unnecessary, but could be misused to undermine the authority of the FCC to protect domestic consumer and business access to the Internet, and promote interconnection among U.S.network providers. Another unintended consequence is that pending legislation like this could actually be counterproductive to our united front in sensitive international debates on Internet freedom by appearing to dictate to other nations what acceptable Internet policy is in their home countries.

H-1B Increase Can’t Wait ‘Til Next Year

The beginning of April brings with it two Opening Days: baseball season and H-1B season.  Opening Day for baseball is a time when fans of every team can look forward to a season throughout which their team can do battle with the players they have assembled in order to have the best chance at success.  By contrast, the H-1B Opening Day is an annual reminder of the visa cap that limits companies’ ability to hire the skilled workers that best fit their needs, with the possibility of the season ending almost before it begins.
