Senate Judiciary Takes Encouraging Step Toward ECPA Reform

Reforming the Electronic Communications Privacy Act (ECPA), designed to protect your online information from unwarranted intrusion by the government, took another step toward reality last Thursday. The Senate Judiciary Committee adopted an amendment to another pending law that would include a portion of ECPA reform. The Committee did not yet pass the amended bill out to the full Senate, instead allowing Senators time to address a few concerns that have been expressed by government.

Encouragement Amid Disappointment on STEM Visas
Yesterday, the U.S. House of Representatives voted on H.R. 6429, the STEM Jobs Act, sponsored by Rep. Lamar Smith, R-Texas, which would increase access to green cards for foreign graduates of U.S. universities with advanced degrees in STEM (science, technology, engineering and math) fields by creating a new green card category of up to 55,000 visas for them.  However, the bill also would eliminate the diversity visa lottery program, which drew opposition from others including House Democrats.  As a result, the bill failed to achieve the required 2/3 majority and was voted down. While this was disappointing, CCIA understands the reasons and is encouraged by the level of bipartisan support voiced on the House floor for STEM visas themselves, and we look forward to further coordination and cooperation on the issue this year.

The German Proposal on a New Leistungsschutzrecht – Endangering Press Diversity and the Digital Economy

Shortly before the next elections in Germany which will take place exactly a year from now, the German government set into motion the adoption of a new copyright law that, if it passed parliament, would be unique in the world. Unique, however, in every negative sense of the word.

Open Internet Rights in America Being Tested in Court

Earlier this week, the FCC filed a Court brief in defense of its open Internet rule that has been challenged by Verizon and one small wireless carrier, Metro PCS.   Verizon claims to support the Internet remaining “an unrestricted and open platform, where people can access the lawful content, services and applications of their choice.”   It simply objects to an FCC rule enforcing that same ideal on behalf of end users and edge providers who must depend on Verizon for that access every day.

How To Reboot WIPO
As CCIA Geneva Representative Nick Ashton-Hart writes in his IP Watch op ed this week, the entire intellectual property community knows there are problems with the World Intellectual Property Organization. "WIPO’s accountability, transparency, and governance are not fit for purpose in the 21st century," he said. The piece goes on to offer brief details on six reforms he recommends that would be a good start.

Brussels is a town full of diplomats, civil servants, lobbyists....and a few politicians. We know that most diplomats are very discreet and that politicians are, well, noisy. But what about trade associations?

CCIA In Leesburg To Monitor TPP Negotiations

Leesburg, Va. – As a round of negotiations on the Trans-Pacific Partnership begins, public interest groups are joining members of Congress in their call for more transparency of the key nine-country trade agreement that’s being billed as the 21st Century Trade Agreement. Canada and Mexico are scheduled to join the next round of talks in December and the treaty is expected to cover broad trade provisions for nations that make up a third of the world’s economy.

IP Policy in a Post-SOPA World

SOPA has not been in the news recently.  It is already starting to seem to some like a piece of Internet history, and in fact was recently a Jeopardy question, tweeted yesterday by Rep. Darrell Issa: “On Jan. 18, 2012 some popular websites went dark in protest of SOPA, a bill to ‘stop online’ this type of theft”
